San Angelo Penny Tap House Murder Suspect Claims He Was Homeless

SAN ANGELO, TX – New information reveals that the murder suspect, who killed a San Angelo man during a fight at the Penny Tap House, is an indigent person.

According to court documents, on Sep. 14, a Tom Green County Grand Jury indicted Jose Trevino Jr. for Murder and Aggravated Assault with a Deadly Weapon.

The alleged assault occurred on Jun. 19. Police officers with the San Angelo Police Department were called to the Penny Tap House that night for report of a possible stabbing victim. When they arrived on scene, the officers learned that a fight had broken out in the parking lot of the club.

During the assault Trevino allegedly knocked Jason Garivay to the ground. Once on the ground Trevino repeatedly stomped on the victim's head and face resulting in serious bodily injury. Trevino then fled the scene with an unknown partner.

Garivay was rushed to the hospital, as police believed he had been stabbed due to the substantial amount of blood on his body. Once at Shannon, doctors discovered that he had, in fact, not been stabbed but had been brutally beaten instead.

While in the emergency room, Garivay went into cardiopulmonary arrest but was resuscitated 10 minutes later. He died later that day.

Police were able to recover surveillance footage which showed that the two had a "distinct escalating issue" inside of the bar. This prompted them both to walk outside. 

The affidavit states that in the video, at first, it shows the victim not having issues in leaving, the next outside surveillance footage show the victim being unable to walk on his own. Garivay was carried to his vehicle, indicative of his initial sustained injuries.

Trevino was then identified, a warrant was issued, and on Jul. 8 he was arrested and booked into the Tom Green County Detention Facility. He currently has a $500,000 bond and is on a hold for violating his parole. Following his arraignment Trevino's lawyer filed an affidavit for indigency. 

Trevino was indicted in Sep. 2021. No other hearing has been schedule for Trevino at this time.
