Man Sues Tom Green County After Allegedly Swallowing Glass in Jail Meal

 

SAN ANGELO, TX — A civil lawsuit alleging an inmate swallowed broken glass hidden in jail food nearly four years ago remains active in Tom Green County district court, with a motion to compel scheduled for Feb. 18.

Herman Tyrone Stanley III filed the suit in February 2024 against Tom Green County, the Tom Green County Jail and several Aramark entities that provide food service to the facility. 

Stanley claims that on May 31, 2022, while detained pretrial, he was served mashed potatoes containing glass shards during dinner. He alleges he swallowed some glass, causing internal injuries that required hospital treatment — including a digital rectal exam and colonoscopy — and led to rectal bleeding for weeks. 

The petition seeks more than $1 million in damages for physical pain, mental anguish, medical expenses, physical impairment and exemplary damages. It accuses the defendants of negligence, gross negligence, negligent hiring and supervision, breach of implied warranties, deceptive trade practices and strict product liability. 

Tom Green County filed its original answer in March 2024, issuing a general denial of the allegations and raising affirmative defenses, including sovereign and governmental immunity under Texas law. The county also contends the jail is not a suable entity and that any potential liability is capped or exempted under the Texas Tort Claims Act. 

Aramark entities filed amended answers and jury demands in 2024. 

Court records show the case is in the discovery phase. Recent filings include the plaintiff’s objections and responses to defendants’ interrogatories and production requests, witness lists and notices of intent to depose Stanley. 

Both sides have demanded a jury trial. The allegations remain unproven, and the defendants deny liability.
