3rd Suspect in Local Texas Rangers Runaway Child Investigation Arrested

 

SAN ANGELO— The third suspect in the Texas Rangers' investigation into a runaway child that was sexually assaulted has been arrested.

Andre Miguel Fay, 46, has been arrested for Indecency with a Child, Harboring a Runaway Child, Possession of Marijuana, and Possession of a Controlled Substances, confirms court documents.

As previously reported, on April 28, 2023, Texas Rangers and the Department of Public Safety assisted each other with the investigation into a 15-year-old runaway child. The victim was observed exiting Room 123 at the San Angelo Lodge, located at 1717 West Beauregard in San Angelo, Texas.

The child victim was accompanied by an adult male, identified as Andre Fay, who was detained for harboring a runaway child. DeAndre Fay, Adam Chappa, and Laila Balderas were also detained as they exited the room.

A special agent said that upon recovery of the child victim, she was taken to the Child Advocacy Center and had a forensic interview performed. The child did not make any outcries at the time but after obtaining consent from the child’s mother, additional questions were asked regarding her activities while at the San Angelo Lodge.

Then, the victim said she was sexually assaulted by Chappa on at least one occasion. It was later determined that Chappa resides in Room 221 with Balderas.

Both Chappa and DeAndre Fay were indicted last month for sexual assault of a child.

During an interview with a Texas Ranger, the child said DeAndre Fay sexually assaulted her three times at an apartment on College Hills. While at the apartment, she said Andre Fay had touched her private area and legs and had also kissed her on the forehead.

A search warrant was executed on the residences and phones were seized belonging to Chappa and both Fays.

Andre Fay was interviewed and he allegedly confessed to touching the child’s buttocks, leg, and kissing her on the lips on at least two occasions. He said the child victim had told him she was 17 and expressed a desire to have sex with her upon her becoming 18. Andre Fay also communicated with her through text messages and some of those messages could be construed as “inappropriate”.

On July 26, 2023, cell phone data was received on DeAndre Fay’s phone, and it was discovered that Andre Fay had sent messages to DeAndre indicating that he had arranged to receive oral sex from the juvenile.

Then, on August 10, 2023, the child was interviewed, and she said she did not agree to the sexual act with Andre Fay, but he did, on more than one occasion, rub his sexual organ on her while clothed.

During the investigation, Andre Fay allegedly admitted that he knew the child victim was a runaway. While the search warrant was being executed on Room 123 at the San Angelo Lodge, which Andre Fay was in control of, approximately 23.82 grams of marijuana, packaging, and vape cartridges containing THC were located.

Andre Fay was arrested and charged with Possession of Marijuana, Possession of a Controlled Substance, Indecency with a Child Sexual Contact, and Harboring a Runaway Child. He was booked into the Tom Green County Jail and is currently an inmate being held on $12,500 bond.
