In a Surprise Move Texas Outlaws Pot-like Delta-8 THC

AUSTIN, TX – The Texas Legislature outlawed the possession of the Delta-8 THC marijuana derivative.

According to the Texas Department of State Health Services, on Oct. 20, Texas Health and Safety Code Chapter 443 (HSC 443), established by House Bill 1325 (86th Legislature), allows Consumable Hemp Products in Texas that do not exceed 0.3% Delta-9 tetrahydrocannabinol (THC).

All other forms of THC, including Delta-8 in any concentration and Delta-9 exceeding 0.3%, are considered Schedule I controlled substances.

This will add Delta-8 to the same list of substances as methamphetamine, heroin, and fentanyl.

A number of vape shops across town currently sell Delta-8 and have made massive profits since putting it on the shelf.

DSHS claims they have no regulatory authority over controlled substances and that all complaints should be handled by law enforcement.
