Fisher Descendants File Motion to Compel Smith to Produce Financial Documents in Disputed Estate Case

 

SAN ANGELO, TX – Attorneys for the descendants of Evalena Fisher filed a motion Wednesday to compel former Rio Concho Communities Director Blaine Smith to produce personal financial documents in the case contesting the alleged will which left Fisher's  $32 million estate to Smith. 

According to the motion filed in Tom Green County Court-at-Law #2 Judge Penny Roberts court, Fisher died May 1, 2017 and the alleged will left the multi-million-dollar estate to Smith.  Smith allegedly wrote the will and had Fisher sign it while she was experiencing diminished mental capacity.  

As we reported earlier, the descendants of the late Evalena Fisher are contesting the will that is being probated in Tom Green County which leaves her $32 million estate to Blaine Ryan Smith at Rio Concho Communities of San Angelo.

According to an answer and counterclaim filed by attorney Jeff Chandler, who represents the surviving heirs, the will was filed with the Tom Green County Clerk's office is dated June 20, 2011 and, "proposes to dispose of Aunt Evalena's estate, which is valued at over $32 million.  A non-family-member and employee of Aunt Evalena's retirement community, Blaine Ryan Smith, seeks to benefit and receive 'all of the real property, including all interests in oil, gas and other minerals' conservatively estimated at over $9 million, plus accrued oil and gas royalty production existing prior to Aunt Evalena's death of over $750,000 (and millions that have accrued since her death)."

The motion to compel states that Smith in 2012 asked for a loan from the estate. "I am currently experiencing some personal financial hardships and am requesting a possible loan off $5,000 to get me through this situation and would request that it bew paid back each pay period with a deduction of $100 over a two year period.  I would pay in back sooner if able.  I am embarrassed to have to aak for this but I would appreciate your consideration." 

The loan request was approved.  Smith making the request was a violation of Rio Concho policy.  According to the motion, when the violation became known, Smith submitted a list of all the gifts he received from Rio Concho residents.  The list includes a gift of $60,000 from Fisher in 2006 and a $145,000 gift from the Maxine Kemble Estate in 2014.  

Smith resigned at the request of the Executive Director and a board member in Dec. 2018.
