Man Facing 99 Years in Prison for Drug Delivery Gets 4 Years Deferred Adjudication

 

SAN ANGELO, TX — A 29-year-old man facing 99 years in prison Thursday pleaded guilty to a lesser drug charge in exchange for four years of deferred adjudication.

Pervis Bing had been indicted on a first degree felony manufacture or delivery of a controlled substance charge which carries punishment of five to 99 years in prison and a fine of up to $10,000.

Law enforcement officers pulled over a vehicle with two subjects in March of 2018.  A search of the vehicle found a small amount of marijuana in the console which the investigating officer stated belonged to Bing.  He also found a backpack that had more that four grams of cocaine.

Bing and his codefendant were arrested and charged with manufacture or delivery of a controlled substance. Testimony Thursday showed two lab tests were performed on the drugs.  The lab tests showed Bing possessed less than four grams of a controlled substance so prosecutors offered to reduce the first degree felony to a third degree felony punishable by two to ten years in prison and a fine of up to $10,000.

The plea deal offered by the District Attorney’s office was four years in prison deferred for four years, a $750 fine and $180 in restitution.  Bing through his attorney Joe Hernandez accepted the plea offer and 51st District Judge Carmen Dusek approved the plea deal.

Deferred adjudication places Bing on probation for four years. He will have to attend substance abuse treatment and report regularly to a probation officer. He will also have to pay $60 per month in probation fees.  If Bing violates any of the terms of his deferred adjudication probation, his probation could be revoked by a judge and he would automatically be sent to prison for four years.  If Bing completes the terms of his probation, he can apply for judicial clemency which could dismiss the felony charge.  Bing now lives in Virginia and is seeking to have his probation transferred there.
