In addition to Cynthia Quigley, who was indicted in the criminal negligent homicide of Officer Korby Kennedy (click here), a grand jury indicted eight additional people on March 15, 2016. Three major cases that made the list include aggravated sexual assault of a child, murder and assault with a deadly weapon.
Murder by Strangling
Kimberly Nichole Linthicum, 31, has been arrested 33 times, and her first arrest dates back to 1997. However, in her latest arrest, she faces a murder charge in the death of Brian Kyle Plunkett, a first-degree felony.
Court documents show that on, or about, the 13th day of June in 2010, Linthicum “knowingly” caused the death of Brian Kyle Plunkett.
Plunkett and Linthicum were involved in an ongoing sexual relationship, and they both used narcotics on a regular basis. They were also acquainted with co-defendant George Dale Simmons. Simmons was also involved in a sexual relationship with Linthicum during this time. Plunkett, who was originally from Louisiana, had made plans to return to his home state. Linthicum was supposed to accompany him.
During an interview, Linthicum provided details of the murder. She said she and Simmons had made arrangements to meet Plunkett and rob him of some guns he owned as well as his cash. Linthicum also admitted she and Simmons believed Plunkett would not resist their efforts to “punk” him of his personal property and currency.
Linthicum also said a physical altercation began between Simmons and Plunkett, and that Simmons got Plunkett into a strangle hold.
“Linthicum stated that Simmons continued to strangle Plunkett until he was dead,” stated court documents.
The altercation took place on a roadside in the area of FM 2288 and Old Sterling City Highway near Grape Greek.
After Plunkett’s relatives confirmed that he had not returned home as planned, a search was conducted. Officials found Plunkett’s body in an area near where Linthicum described. The body was recovered in a near skeletal condition on or about Oct. 25, 2010. A forensic DNA test was conducted, and that test confirmed the remains to be those of Plunkett.
Aggravated Sexual Assault of a Child
Christopher Partida, 18, was indicted for the aggravated sexual assault of girl younger than 14 years of age, also a first-degree felony.
According to court documents, San Angelo Police Officer C. Moore was dispatched to the 400 block of Baker on Jan. 4, 2016, and determined Partida had sexual intercourse with the victim, a girl 13 years of age. Officer Moore then located and detained the defendant in the 600 block of Baker.
The victim, during an interview, said on Jan. 4 and Jan. 6, she had intercourse with the Partida. She also said she was 12 when she and the defendant started talking, and Partida knew her age.
She also knew his age.
After officials interviewed him, Partida was “read his Miranda rights, waived his rights, signed the Miranda card and gave a verbal statement,” stated the court documents.
Partida does have a previous record that includes burglary, theft, possession of marijuana and paraphernalia.
Aggravated Assault with A Deadly Weapon
Austin Ray Carpenter, 18, has been arrested nine times, and in his latest arrest, he faces an aggravated assault with a deadly weapon charge, a second degree felony.
On Dec. 17, 2015, Carpenter “intentionally, knowingly, and recklessly caused bodily injury to Justin McCarty by striking him.” Carpenter, during the altercation, used or exhibited a deadly weapon, which happened to be a firearm, during the assault.
In addition to these three cases, and that of negligent homicide in the death of Officer Kennedy, the other indictments for March include burglary of a building, theft, possession of a controlled substance, unlawful possession of a firearm by a felon and credit card or debit card abuse.
