Man Takes Plea Deal After Crash Injures Woman, Alcohol Twice the Legal Limit

 

SAN ANGELO, TX — A San Angelo man has taken a plea deal after causing a serious crash that badly injured a woman.

Clayton Lindsey, 52, of San Angelo, has taken a plea deal for intoxication assault with a vehicle causing serious bodily injury.

According to court documents, on October 21, 2017, around 6 p.m., a DPS Trooper was dispatched to the intersection of Log Cabin Trail and Sykes Circle regarding a crash. When the trooper arrived, a motorcycle was observed in the bar ditch on its side. The driver was identified as Lindsey, and his passenger was receiving medical attention. The odor of alcohol was emitting from Lindsey’s breath.

One of the medics on scene said that the passenger had two broken arms, one of which had a compound fracture.

A crash investigation was conducted, and it was determined that Lindsey was traveling at an unsafe speed to make the curve in the road. The foot peg of his motorcycle struck the roadway causing Lindsey to lose control and end up in the bar ditch.

Both Lindsey and his passenger were transported to Shannon Medical Center. A trooper responded to Shannon as well and performed a Horizontal Gaze Nystagmus test but due to his injuries, no other field sobriety tests were conducted. A voluntary blood specimen was requested of Lindsey, but he refused until a warrant was secured. This specimen was sent off for later that day for analysis.

Lindsey was released and admitted for medical treatment and troopers left to generate citations for him. When they returned, Lindsey had left the room.

A nurse said Lindsey had left out the back door with family members. When asked why he left, Lindsey stated that he refused medical treatment. The trooper informed Lindsey that if he refused treatment, he would be arrested, after which he was placed under arrest.

At the jail, Lindsey had a physical performed by one of the nurses who said they could not take him due to his injuries. Lindsey then requested medical attention, and he was released back to Shannon Medical Center.

Lindsey’s blood specimen result came back and indicted that he had a blood alcohol content of .135 about three hours after the crash.

In exchange for a guilty plea, Lindsey was sentenced to eight years-probation, 10 years inside the Texas Department of Criminal Justice, and must pay $60 in restitution.
