INDICTMENT: Violent Habitual Criminal Attacks Business Owner with Tire Iron

SAN ANGELO, TX --  A man was indicted Tuesday after attempting to attack the owner of Fisher Rig Works with a tire iron.

On May 28 at around 1 a.m. an employee of Fisher Rig Works noticed a man and a woman rumbling through tools inside the shop. When the employee asked the man what he was doing he recognized him as 28-year-old Matthew South. The employee could not recognize the woman.

According to the affidavit, South told the man that if he saw the owner that he was going "F*** him up." The employee then left the shop and went to find the owner.

When he spoke to the owner, Fisher, about what happened, Fisher grabbed his pistol and went into the shop to confront South.

Police say this is when South began walking at a quick pace towards Fisher saying "I'm going to f*** you up." This made Fisher fear for his life so he took out the pistol and shot above South's head. Fisher told police that he didn't shoot South because he did not want the unknown girl to be hurt.

After the shot was fired the girl screamed for South to let them leave so he dropped the tire iron and left the shop.

South was arrested on June 4 and is still in the Tom Green County Jail. His bond is set at $75,000.

South has been indicted on one count of aggravated assault with a deadly weapon.
