ABILENE, TX-- The charges against a former Child Protective Services supervisor in a case regarding a toddler's death in Abilene have been dropped by a judge.
KTXS News reports that Martha "Bit" Whitaker, 62, will not face criminal charges for tampering with evidence pertaining to the 2012 investigation of Tiffany Klapheke.
Klapheke was found guilty of three counts of child neglect and sentenced to 30 years in prison in the death of her 22-month-old daughter, Tamryn. She died at the family home on Dyess Air Force Base.
Whitaker was the supervisor for CPS while they were investigating Klapheke before Tamryn's death. They closed the case just six days before the death.
The motion to dismiss obtained by KTXS from the State said it "cannot prove the charge beyond a reasonable doubt."
The motion was granted by Judge Jay Gibson.
