SAN ANGELO, TX -- Robert Lamar Miller’s attorney filed a motion to suppress evidence and statements he made to authorities stating the evidence and statements were obtained illegally.
Attorney Brian Raymond filed the six page motion Tuesday on behalf of Miller who remains jailed in lieu of $750,000 bond. Miller and LuDonna Yoder are charged with murder in the death of his former wife Naomi Michelle Miller.
Raymond’s motion contends that Miller, “was deprived of his right to counsel and did not intelligently, understandingly or knowingly waive his right to counsel or right to remain silent.”
That evidence would violate Miller’s Constitutional Rights under the fourth and fifth amendments.
Miller’s body was found by authorities at the former San Angelo Raceway in the 3000 block of FM 2105. According to court documents, Miller was killed in 2005.
District Judge Ben Woodward will consider the motion and set a hearing to hear arguments from Raymond and prosecutors.
Robert Miller’s jury trial for murder is set for February 20, 2018.
