Arrest Affidavit: Details on Disappearance and Murder of Naomi Michelle Miller

 

SAN ANGELO, TX – This afternoon, LIVE! obtained the official complaint in the arrest of 45-year-old Robert Lamar Miller, II, who was arrested last week for the murder of his wife, Naomi Michelle Miller. Yesterday, volunteers with the Texas Search and Rescue, with the help of K9 Orion, found the body believed to be Naomi (see our stories on this case here, here and here).

In the complaint, Tom Green County Sheriff’s Office Sgt. William (Billy) Fiveash confirmed his belief and charge of murder against Miller.

“Robert Lamar Miller, II did then and there intentionally and knowingly cause the death of Naomi Michelle Miller, white female,” said the complaint.

Fiveash added that his belief is based on information received in this case. On Wednesday, May 13, 2015, the Sergeant was contacted by a family member who reported Naomi had been missing for a period of several years, possibly since 2005.

“The complainant expressed concern Naomi Michelle Miller may have met with foul play at the hands of her husband, Robert Lamar Miller, II,” the complaint stated.

After this contact, Sgt. Fiveash conducted research using various databases including social security administration information, driver’s license history, a CLEAR search, voter registration, NDex, Lexis Nexis, public assistance directories, National Insurance Crime Bureau, school records for her children, Medical Insurance Bureau, tax records, social media, claims.org, find a grave, United States Postal Service, and other law enforcement databases to identify and locate Naomi.

Fiveash additionally requested assistance from Texas Ranger Nick Hanna, who also conducted his own search.

The complaint noted, “As a result of these and other searches, incidents involving Naomi Michelle Miller were discovered to include a traffic stop on 06/27/2005, communications for traffic citations through Tom Green County Justice of the Peace, Precinct 3, with Naomi Miller’s final contact with the court on 07/19/2005. Work records through the Social Security Administration were located and determined to have occurred during the work year of 2002.

Next, Sgt. Fiveash contacted Naomi’s parents to determine the last contact they had with their daughter. They confirmed that was in 2005.

“In summary, [Sgt. Fiveash] located numerous articles of evidence to support the activity and life of Naomi prior to and including 2005,” read the complaint. “[Fiveash] was unable to locate any evidence supporting the life or activities of Naomi after the calendar year 2005.”

On May 20, 2015, Sgt. Fiveash interviewed Robert Miller’s family, who indicated that Robert had made comments about killing Naomi and hiding her body under his residence in the 11000 block of Glass Road in San Angelo.

On June 3, 2015, Sgt. Fiveash and other law enforcement personnel conducted a consent search of the residence and utilized Dog Handler Vi Shaffer of K9 Specialty Detection and her cadaver dogs True and Spirit.

“These dogs are trained to alert only on the scent of human remains and/or decomposition and are certified by Law Enforcement Training Specialties International,” stated the complaint.

During their search, the K9s alerted law enforcement to an area at the residence. A manual search of the area uncovered “a depressed area consistent with a clandestine grave;” but no human remains were found.

Additionally, carpet fibers were recovered among and mixed into the soil of the believed to be clandestine grave, and investigators located an unusual modification to the kitchen floor to allow access to an area directly above where the grave was potentially located.

On Oct. 18, 2015, Naomi was entered into the National Missing Person Database. A search of the database unfortunately did not produce a positive finding for Naomi’s remains.

On March 1, 2017, Sgt. Fiveash and Ranger Hanna interviewed a woman who resided in the home of Robert and Naomi Miller in December of 2005.

In a sworn, written affidavit, the woman advised during that month, she had witnessed a domestic dispute between Robert and Naomi. She said the dispute occurred in a bedroom of the residence, and, following the dispute, the woman witnessed Robert carrying an object believed to be the body of Naomi wrapped in bedding.

“The following day, [the woman] indicated she observed freshly turned dirt in the backyard of the residence,” said the complaint. “Additionally, the confidential informant detailed the location of the dirt in the backyard.”

Investigators did note the area, and indicated it was the specific location where the cadaver dogs had subsequently alerted law enforcement to the presence of human remains.

“The confidential informant relayed she never heard or saw Naomi Michelle Miller again, subsequent to the incident,” noted the complaint.

The woman also said Naomi’s belongings, including clothing, a cell phone, and her vehicle, were left at the residence in a manner inconsistent with those of someone leaving for an extended period of time. Naomi’s cell phone was given to the woman and utilized by her, the complaint stated.

Also, the woman told officials Robert physically assaulted her, recently threatened to kill her and warned her to “shut your damn mouth.”

After speaking with the informant, Sgt. Fiveash and Ranger Hanna interviewed Robert Miller, who was in custody at the McCulloch County Sheriff’s Office on unrelated charges.

“Robert Miller confirmed the relationship with Naomi Michelle Miller as well as the confidential source,” read the complaint. “Robert Miller confirmed he had engaged in an argument with Naomi on the night of her disappearance, but stated she had left in the middle of the night with an unknown boyfriend.”

However, investigators noted the compelling circumstances regarding the abrupt fashion in which Naomi’s activities ceased, her lack of communication with her children, and evidence resulting from the investigation, and how these facts and circumstances led to the belief that Robert Miller murdered his wife. As a result, an arrest warrant was issued on March 2, 2017 for Robert Miller’s arrest.
