SAN ANGELO, TX -- Ludonna Yoder’s attorney attempted to get her final statement suppressed during a pretrial hearing Monday. That fourth written statement is where Yoder admitted her participation in the death and disposal of Naomi Michelle Miller.
Yoder, 42, was married to Robert Lamar Miller who is charged with murder in the smothering death of his former wife. Her body was found March 8, 2017 buried at a former race track on FM 2105 north of San Angelo. She was killed in December 2005.
Texas Ranger Nick Hanna was called to the witness stand Monday. Hanna testified that he and Tom Green County Sheriff’s Sergeant Billy Fiveash interviewed Yoder on four separate occasions from March 3 to March 13. Hanna said Yoder told them she was not involved in Miller’s death during the first three interviews. Hanna told the court that Yoder drove herself to each of the interviews and was never under arrest so she wasn’t read her miranda rights.
Yoder’s attorney asked to court to suppress the final interview because it was basically given knowing that she was going to be arrested. Prosecutors argued Yoder wasn’t under arrest until the day after the final statement was taken.
Fiveash and TGCSO Lieutenant Andrew Alwine also testified. After closing arguments in the hearing, District Judge Jay Weatherby denied the motion to suppress the statement.
Yoder’s jury trial for murder is set for February 20, 2018.
