SAN ANGELO, TX — A West Texas company says it suffered losses after a Mississippi contractor allegedly backed out of a $250,000 solar farm materials deal.
TBH Trucking and Construction, L.L.C., based in Bronte, filed suit against J.E. Shurden Construction, L.L.C., claiming breach of contract and fraud after TBH began delivering material for the project in August 2024.
According to the lawsuit obtained by San Angelo LIVE!, in October of 2023, TBH sent bids to different contractors regarding the ability to supply and lay base material for a solar farm project in Runnels County, Texas.
The company says it had prepared to supply 40,000 tons of caliche at the defendant’s request, only for J.E. Shurden to cancel the remainder of the order after receiving 237 truckloads of material, or about 10,000 tons.
The lawsuit, initially filed in Runnels County, was moved to federal court in San Angelo on May 12. J.E. Shurden Construction cited diversity of citizenship and the amount in controversy as grounds for removal, noting the companies are based in different states and the dispute exceeds the $75,000 threshold for federal jurisdiction.
TBH alleges that J.E. Shurden approved the caliche in July 2024 via text, stating “the caliche gravel got approved,” but later notified TBH in September that the remaining material would not be purchased. The suit seeks damages for out-of-pocket costs, storage, and unpaid contract balances.
J.E. Shurden Construction is registered in Mississippi and lists its principal office in Maben. TBH is based in Coke County and operates throughout the Concho Valley.
