Hearing Held on Motion to Disqualify District Attorney from Robert Lee Murder Case

SAN ANGELO, TX -- Defense attorneys for Jasmine Moreno who is accused of shooting and killing her husband in Robert Lee are seeking to disqualify District Attorney Allison Palmer from prosecuting the murder case and a visiting judge held a hearing on the motion Friday afternoon in San Angelo.

Visiting judge Mike Freeman of Waco heard arguments from both sides about the motion to disqualify Palmer. 

Defense attorney Frank Sellers filed the motion to disqualify Palmer saying she knew Jasmine Moreno and wanted to prosecute Cisco Moreno for assaulting his wife on several occasions.  Sellers said Palmer knew Jasmine and that disqualified her from prosecuting her because Sellers plans on calling Palmer as a material witness. 

Sellers called Palmer to the stand Friday and grilled her about a subpoena he issued for her testimony.  

Judge Freeman didn't seem to be amused at Seller's attempts to paint Palmer as biased against Moreno.  

Palmer and Sellers seemed to dislike one another in the court room.  

Palmer testified that she wasn't going to be the attorney to prosecute Moreno.  She said she would assign an Assistant District Attorney from her office to prosecute the case. 

Sellers said that wasn't up to Palmer.  He said the court should appoint a special prosecutor to try the case. 

At the end of the hearing, Judge Freeman said he would take all the evidence and testimony under advisement and issue a ruling at a later date.  

District Judge Carmen Dusek will preside over the murder trial in Robert Lee.
