SAN ANGELO, TX - This afternoon at the Tom Green County courthouse, Guadalupe Wally Olvera pleaded guilty to aggravated robbery, a first degree felony.
As a result of the plea, 340th District Judge Jay Weatherby accepted the State of Texas' recommendation and sentenced Olvera to 15 years in a TDCJ institution. He also must pay $4,368 in restitution.
Judge Weatherby reaffirmed that, by signing and agreeing to the plea bargain, Olvera would no longer have the right to appeal the decision.
"Yes, sir," Olvera declared, accepting the charges without hesitation.
Judge Weatherby also explained Olvera will receive credit for time served from January 27, 2016 to today.
Guadalupe "Wally" Olvera, along with co-conspirator Magdaleno Suniga, Jr, who received a 18 year sentence (read the trial here), robbed the Stripes at 1821 N. Bryant Blvd. on Jan. 27, 2016. Other arrests were made in the robbery, including a few juveniles.
Throughout the hearing, Olvera remained cordial, with his ankles and wrists restrained, as he answered all of Judge Weatherby's questions. He faced a sentence of 5 to 99 years, and a fine not to exceed $10,000.
According to court documents, on the day of the robbery in January 2016, two Hispanic males with bandanas covering their faces with handguns entered the Stripes on Bryant and demanded the clerk give them money from the safe. As the clerk unlocked the safe, one man pointed the gun at her while the other took the money (For more on the story, click here and here).
As stated previously, these men are members of the Darkside gang.
