SAN ANGELO, TX - A grand jury met for one day this month, on Aug. 4, 2016, and indicted 58 people in Tom Green County. As usual, drugs topped the list of offenses, but here are the more noteworthy cases to be on the lookout for at the Tom Green County Court.
Man Sexually Assaults a Child Under 6 and Evades Arrest
Oscar Cardinez Perez, Jr., 27, was indicted on two charges this month: Aggravated Sexual Assault of a Child and Evading Arrest Detention w/ Previous Conviction.
According to the complaint, on or about Feb. 1, 2016, Perez sexually assaulted a child younger than 6 years of age. On Feb. 23, 2016, the victim made an “outcry” against Perez.
In an interview, the victim told officials Perez “touched her private parts.” She said Perez took her into the bathroom, shut the door, and proceeded to sexually assault her. She said Perez stopped because he “thought someone was coming.”
Perez told the child to keep their secret.
During an interview, Perez told officials he “did not believe that he had sexual intercourse with the victim, but stated that it was possible while he was intoxicated on methamphetamine.” He told officials that “he would believe” what the victim stated.
This charge is a first degree felony, and Perez’s bond is set at $75,000.
As for the second charge, Perez, on or about June 3, 2016, attempted to evade arrest for the charge.
On that day, Officers Salmon and Kyle Green attempted to serve a felony arrest warrant in the 2300 block of Weaver. Upon arrival, Officer Salmon watched the rear of the house while Officer Green knocked on the front door. Officer Salmon saw Perez exiting a window on the southeast side of the house. He looked at Officer Salmon, and then he fled south in the alley. The officer pursued him.
As he ran, Perez looked back at Officer Salmon and began yelling, “What are my charges!” He continued to run and yell the statement until Salmon reached and tackled him. He then explained the charges to Perez.
The Evading Arrest Detention w/Previous Conviction is a State Jail Felony, and Perez’s bond is set at $10,000. Perez has been arrested 14 times in Tom Green County.
Man Sexually Assaults a Woman
Another Defendant to make the indictment list in August is Robert David Smith, 46. On or about June 14, 2016, Smith “knowingly [caused] the penetration of the female sexual organ” of a victim without effective consent.
On June 14, San Angelo Police Officer Matthew Faz was dispatched to the 700 block of Powell Street in reference to an unknown problem and located the victim near the intersection of Powell and Baker Streets. Officer Faz said the victim was bleeding from her nose and mouth, and told the officer she had just been sexually assaulted by Smith. Officer Dakota Martin was able to locate Smith at his residence on Powell Street.
When Detective Adrian Castro spoke with the victim, he observed visible bodily injury to her face and neck. The victim told Castro that Smith caused the injury by choking and hitting her while sexually assaulting her.
Smith confessed to physically choking and sexually assaulting the victim. He faces a second degree felony for the charge, and his bond is set at $25,000.
This is Smith’s only arrest in Tom Green County.
Man Attacks Another Man with Knife
Jeffrey Clifton Delone, 50, was indicted for Aggravated Assault with a Deadly Weapon. According to the complaint, on June 18, 2016, Delone was released from the Tom Green County Jail. Upon his arrival home, he contacted his wife and was upset that he had to walk home from jail.
A verbal argument ensued between the couple, and the victim, Cole Pierce, attempted to defend Mrs. Delone. At that point, Jeffrey Delone produced a “fixed blade knife from its sheath on his person and lunged toward” Pierce.
A witness present was able to physically intervene and allow Pierce the opportunity to escape danger; however, Pierce said he “was in fear for his life and learned that [Delone] threatened to kill [him] when he lunged toward him with the knife.”
Delone’s charge is a second degree felony, and his bond is set at $20,000. The Defendant has been arrested in Tom Green County 13 times.
Man Shoots Dog
Byron Clay Odell, 52, on or about June 8, 2016, intentionally, knowingly, and recklessly caused bodily injury to a dog by shooting it “without consent of the owner,” read the indictment.

PermalinkI don't care what you call it but Rape is rape. That child was brutally raped as was the woman. Please call it what it is! Stop trying to make it sound like something minor just happened.
