A couple who claimed they’d been out all night fishing early this morning were taken into custody and jailed when deputies with the Tom Green County Sheriff’s Office noticed an AK-47 lying on the back seat of their vehicle.
Gerardo Reese Constancio, 23, and Fantasia Monique Martinez, 21, were cruising in the 7400 block of Knickerbocker Road at approximately 4:28 a.m. when Chief Deputy Dale Pearce heard gunshots ring out and spotted the two in a blue Ford Explorer, TGCSO Lieutenant Christina Lopez said.
Pearce called dispatch for back up and the vehicle was stopped, at which point Martinez and Constancio told officers they had been fishing out at the lake the whole night.
After detaining both Martinez and Constancio, deputies noticed the assault rifle lying in plain view in the back seat. A search of the vehicle revealed spent bullet casings in the front of the car, near the center console, Lopez said.
Constancio, a felon with a March 13, 2012 conviction for aggravated assault with a deadly weapon, is not permitted to have firearms and was arrested for unlawful possession of a firearm by a felon and deadly conduct, discharge firearm, both third-degree felonies. Martinez does not have any prior felony convictions and was charged with deadly conduct, discharge firearm.
Both were transported to the Tom Green County and booked between 6-6:23 a.m.
No one was injured during the incident.

I believe you have a typo in your article. I don't think they had a fully automatic weapon. More then likely it was semi automatic. the term "Assault Rifle" comes from the German Sturmgewehr. The Sturmgewehr was the first real Assault Riffle and the name was given by Hittler. A true assault rifle is a fully automatic or select fire weapon. These type of weapons have had very strict controls on them starting in 1968 and no new ones have been allowed to be produced since 1986 for the public. I know its popular for the media to use the term on a regular basis sometimes from ignorance of the meaning and sometimes to try and demonize firearms.

PermalinkIt's a blatant attempt to scare the ignorant public into viewing these types of rifles as somehow dangerous. Remember back in the 80's when the Brady bunch tried to label any rifle with a scope as a sniper rifle? In the United States, the term 'assault rifle' was First incorrectly used to to label these types of guns during the Assault Weapons Ban enacted in 1994 by the Clinton administration. You are more than three times as likely to die in an automobile accident as you are by a firearm...yet we don't label them "assault vehicles." The reasons are because the general population has been educated in the safe use of a motor vehicle, and because we see them everywhere.
What makes this AK-47 an assault rifle? Was it fully automatic? Maybe. More than likely it was Ms. Reinhard's parroting of the phrase either without fully understanding what it means or by attempting to further the lefts agenda by labeling this gun something that it's not.
Anyhoo...I must end this rant as I have to go eat dinner with my assault fork now.

I too am having dinner with my assault knife and semi-automatic cooking device (the microwave). Sounds much better.

PermalinkHexi, thanks for pointing that out. I double checked and noticed I had written his age down wrong initially. He is actually 23. I have corrected the story to reflect this.
As for the "assault rifle", the gun was referred to as such as I gathered information for the story. I repeated it. No leftist agenda, or anti-gun conspiracy. If I were a part of either, I likely wouldn't sneak it between the lines of a story on 'candidates for the Darwin award', as hexi put it.

I appreciate the response to the questions. Most media would not dare to step to a "low point" in defending or answering why they wrote a story the way they did to us little people. As long as you are aware the term used is incorrect use of the English language. It would be nice though that when it is known incorrect language is used that a few quotes were added.

PermalinkI don't think it matters if it's called an "assault rifle" or not. The term better conveys the lethality of the weapon and makes it easier for people to understand why law enforcement would arrest a felon for having one. It's a logical word choice, regardless if it's technically correct or not.
As a veteran I've commanded a machinegun crew and I've also had the disconcerting experience of having a magazine run out on me while in a fire fight. I'd rather take a semi-automatic weapon over full auto any day. In the hands of an irresponsible idiot like this though it doesn't really matter; either mode of fire is equally destructive.
Many versions of the AK do come with fully automatic fire, I know I saw plenty in third world countries like that. But, even if this wasn't a fully automatic AK I doubt there is any sort of conspiracy here on the part of the reporter by calling the weapon an "assault rifle". It's a very logical choice of words to use for such a weapon.
And, before anyone takes this as an attack on the 2nd Amendment, I fully support the right of all responsible and law abiding citizens to own such weapons. I also support law enforcement's efforts to keep them out of the hands of folks like these.
And I support media who simply report the facts without bias...

Bravo for you on using your first amendment rights by saying what you did.
Now with what you said I would like to break a few things down that may be misunderstood by the average person. When you use the phrase "The term better conveys" i don't think you give the correct picture to the readers. The one thing we have is our language and it is our language that allows us to communicate correctly to each other. You cant just say its a "logical choice" or "regardless if its technically correct". By changing the meaning of things to meet your personal definition you lessen our ability to communicate correctly.
Yes I am sure the you have seen may AK variants during your career in third world countries but this is not a third world country. Also with the way class 3 firearms are dealt with in the US I am sure that the charges would be very different then what they have been charged with and in this case would have no bearing if they were arrested or not as what they were doing I am sure will be proven illegal in a court of law.
On your comment about "media bias". I did not say this website had media bias I only said that the term is used most likely in two ways ( in my opinion) in the media.
1. is out of ignorance and not understanding the difference ( this is most likely the case here)
2. it is sometimes used by those that have an agenda and like to use words in a way to shape the way people think. ( this is most likely not the case here)
Please understand that the term ignorance is not always meant to be a derogatory term. If you are not educated on an item then by definition you are ignorant of the item you are speaking about until you educate yourself about the subject.
I also don't believe I tried to convey that there is some sort of "Conspiracy" about the media in reference to this site. It has been shown before and according to the outgoing AG Eric Holder "We must brainwash people about guns" . Other news outlets such as CNN have admitted to faking and misrepresenting facts about so called "Assault Weapons" in the past. With this said when someone admits they had an agenda it cant be a conspiracy. Now again please don't imply that I am saying there is a conspiracy with this website I am only using your words not mine as I don't believe there is any conspiracy with this site.

PermalinkLet this be a lesson to you. When you're out doing things you aren't supposed to, these are the consequences of getting caught! Remember: Getting caught is a crime! 100% percent of all convicted criminals got caught, or appeared convincingly guilty of whatever they got caught for. That is also true for 100% people who were punished but didn't actually commit any crime. Carelessness, like leaving the assault rifle in the back seat - instead of disassembling it and hiding the parts throughout hollow parts of the facade of the vehicle's interior (or well concealed in the upholstery of the seats) or simply fastening it securely to the bottom of the vehicle after wrapping it in protective materials - is a big no-no! And, more often than not, hiding your items is much simpler than that. You have to think things through!

PermalinkI incorrectly stated a date in my previous post at the top. The controlling of automatic weapons for the public started in 1934 not 1968. The 1968 law created the federal firearms license aka FFL dealers.
