Trump Signs Order Directing DOJ to Prosecute Flag Burning

 

WASHINGTON — President Donald Trump on Monday signed an executive order directing federal agencies to prosecute flag desecration and strengthen measures to protect the American flag.

The order instructs the attorney general to vigorously prosecute violations involving flag desecration and pursue litigation to clarify the scope of First Amendment protections in this area. It also directs the attorney general to refer cases that violate state or local laws to appropriate authorities.

For foreign nationals, the order authorizes the Departments of State, Homeland Security, and Justice to deny visas, revoke immigration benefits, or seek removal from the United States when flag desecration permits such remedies under existing law.

The White House described the American flag as “the most sacred and cherished symbol of the United States of America,” calling its desecration “uniquely and inherently offensive and provocative.” The fact sheet stated that recent protests, including demonstrations in Los Angeles in June 2025, featured flag burning alongside violent acts that threatened public safety.

“Such conduct disrespects the sacrifices of Americans who bled for our country, and undermines the flag as a symbol that unites and represents all Americans of every background and walk of life,” information in the fact sheet states. 

The order is part of Trump’s broader effort to reinforce patriotism and restore pride in national symbols. It follows actions such as banning non-U.S. flags at State Department facilities, protecting monuments from vandalism, launching the America 250 Commission, and directing the Smithsonian Institution to ensure its exhibits celebrate American exceptionalism.

Trump has long condemned flag burning, previously calling it “disgraceful.”
