AUSTIN – Governor Greg Abbott said Saturday that he intends to seek a pardon for an Army Sergeant recently convicted of murder for shooting a Black Lives Matter protester during an anti-police demonstration in 2020.
According to Fox News, Violent protests, riots, and killings, in the name of the Black Lives Matter movement erupted across the country in the summer of 2020. Late one Saturday night over the course of that summer, Army Sergeant Daniel Perry turned a corner in Austin, Texas, and found himself surrounded by an angry mob of protesters sparking an encounter that left one man dead and has Perry facing life in prison.
On the night of July 25, 2020, at about 9:15 p.m., authorities say Perry was driving for Uber to make some extra money in downtown Austin and encountered a group of Black Lives Matter protesters who lacked a permit for their protest. They were illegally clogging the intersection, as protesters had done around the city several times in the weeks prior. Video shows that as he made the turn that night protesters quickly surrounded Perry's car and began pounding on it and throwing rocks at it.
Perry, an active duty soldier stationed at Fort Hood at the time, says a masked man approached his vehicle with an AK-47 in the "ready" position. When that man, Garrett Foster, 28, raised and pointed the rifle at Perry, the Army sergeant and licensed concealed handgun carry permit holder, grabbed a handgun that he carried for personal protection and fired at Foster, fatally wounded him.
In a tweet, the Governor said, "Texas has one of the strongest "Stand Your Ground" law of self defense that cannot be nullified by a jury or a progressive District Attorney. Unlike the President or some other states, the Texas Constitution limits the Governor's pardon authority to only act on a recommendation by the Board of Pardons and Paroles. Texas law DOES allow the Governor to request the Board of Pardons and Paroles to determine if a person should be granted a pardon. I have made that request and instructed the Board to expedite its review. I look forward to approving the Board's pardon recommendation as soon as it hits my desk. Additionally, I have already prioritized reining in rogue District Attorneys, and the Texas Legislature is working on laws to achieve that goal."

PermalinkThe guy he shot is literally on video a few hours earlier bragging about how people are too scared to do anything, when they go around armed and intimidate drivers and pedestrians. A pardon is absolutely necessary. Should’ve never been in court to begin with.

PermalinkIt's a damn shame this Army Sergeant has had to spend time in prison for defending himself against a man with an "assault rifle" (you know, one of those guns that cause normal people to kill innocent people) because some woke prosecutor is trying to advance his career. So many times, someone that needs to go to prison gets probation, probably for the same reason.

PermalinkAmigo, the only part of your post I find arguable is your description of an "assault rifle". Those damned things also allow already disturbed people to kill far more innocent folks than they could had they access only to weapons more appropriately owned by civilians... such as the ones I own.

PermalinkI feel sure we could debate this for hours and neither of us would gain any ground. For a second lets pretend the AR platform does not exist. We won't discuss these same crazy people using bombs, fire, poison or vehicles. I also won't argue the fact that semi auto as well as full auto weapons have been available to the public for the last 100 years. The mass shootings that have become so common were almost unheard of not so long ago. I believe we need to quit blaming weapons and start looking for the real causes. If I was a crazy person and wanted to commit mass murder, my weapon would be a sawed off 12 ga pump shotgun. Your average pump holds 5 rds, some hold 8. A very common rd is a 00 buck. One 00 buck fires 8-30 cal pellets all at once and it is very powerful. 5 x 8 = 40 rounds of 30 cal in about 10 seconds or less (much faster than an AR). They make loading tubes which will allow you to reload very fast. My point is I don't believe the AR facilitates mass murder anymore than many other available weapon such as bombs, fire, poison, vehicles, older semi auto weapons or even the common shotgun. If a mass murderer wants to do evil, there is always a way.

Having said that, I look at the ease with which these hellguns can be obtained, and I look at how often they are used in mass killings. I confess I have no answer for the horrors that we all too often see nowadays. I can just say with absolutely certainty I will never own one of those goddamn things or understand anyone's wanting to have one.
