WASHINGTON, D.C. – The U.S. Supreme Court on Friday ruled that Texas' heartbeat law will be able to continue without further outside law suits.
On Oct. 7, U.S. District Judge Robert Pitman, appointed during the Obama administration, put a stop to the bill after the Biden administration sued the state of Texas. Following this decision, the 5th Circuit Court of Appeals in New Orleans over ruled the federal district judge's decision to temporarily block the Texas Heartbeat abortion law.
Now the U.S. Supreme Court has ruled in favor of Texas.
"The Court concludes that the petitioners may pursue a pre-enforcement challenge against certain of the named defendants but not others," said the court, led by Justice Neil Gorsuch."The petitioners then filed a request for injunctive relief with the Court, seeking emergency resolution of their application ahead of [the law's] approaching effective date. In the abbreviated time available for review, the Court concluded that the petitioners’ filings failed to identify a basis in existing law that could justify disturbing the Fifth Circuit’s decision to deny injunctive relief."
Now the abortion ban will remain in affect.
