Two Believed to Have Connections to Rose Murder Arrested Following Thursday Burglary

SAN ANGELO, TX – Two men accused of murdering Kristian Rose were apprehended yesterday in a police response to a burglary near the Angelo State University campus Tuesday.

Yesterday at 11:20 a.m., police surrounded two suspects attempting to flee what was described to the responders as a burglary in progress at the Tuscany Apartments, 1810 S. Fillmore St. Police were told suspects were attempting to gain entry into the apartment through a window.

As police converged on the scene, two suspects were seen attempting to flee in a black passenger car. Police drew their weapons and took two men into custody at gunpoint.

When we arrived at the scene, we saw police taking one of the suspects to the ground. The other was already handcuffed and was being placed into the back of a police car. Police arrived at the scene of the burglary so fast that they were able to block all exits from the parking lot preventing the suspects’ escape.

Police said they found methamphetamine and three firearms on the suspects. At least one of the firearms was stolen recently, police said.

Police booked Brian Garcia, 20, and Jacob Martinez, 18, into the Tom Green County Jail.

Garcia was charged with Burglary of a Habitation While Intending to Commit Another Felony and Manufacture/Delivery of a Controlled Substance Penalty Group 1. The exact charge is he was in possession of between 4 grams and 200 grams of meth.

Martinez was charged with an identical burglary charge and theft of a weapon and possession of a prohibited weapon.

The arrests led to gaining more evidence in the investigation of the April 2 murder of Kristian Rose. With probable cause gained from the new evidence, police were able to obtain search warrants to look at two residences, one in the 400 block of Angelo Blvd. and the second in the 2400 block of N. Lillie St.

As a result of more evidence gained executing the search warrants, Garcia and Martinez were formally charged with Murder.

No bond is published for either suspect.

Brian Garcia was accused of stealing a "water" pipe at gunpoint from the Love Shack head shop in 2017. His charges were enhanced due to a prior conviction for theft of a firearm and possession of a firearm by a felon. He was out of jail awaiting a June 2019 trial date on a $50,000 bond, according to court records. Jacob Martinez was serving three-years probation for theft of a firearm. He was given deferred adjudication for the prior offense by a Tom Green County district judge.
