SAN ANGELO,TX -- A San Angelo man was sentenced to prison Wednesday for touching a girl almost 50 years younger than he was at the time of the alleged crime.
Fidencio Garcia was 62-years-old in July 2018 when he drove the minor girl to the store and purchased candy for her.
In a forensic interview after the event, the victim told police Garcia put his right hand under her shorts and touched her sexual organ while they were driving between Freeland and Jackson St.
Garcia's attorney Fred Brigman told District Judge Ben Woodward that Garcia was hard of hearing and illiterate. The judge spoke slowly and clearly so Garcia could understand the court proceeding.
Garcia pleaded guilty to one felony count of sexual assault of a child and one felony count of indecency with a child by sexual contact.
Both counts are second degree felonies punishable by two to 20 years in prison and a fine of up to $10,000.
In exchange for his guilty plea, Garcia accepted an offer from the District Attorney's office for seven years in prison on each count.
District Judge Ben Woodward accepted the plea deal and sentenced Garcia to seven years in prison on each count and also ordered him to pay court costs.
The sentences will run concurrently.
Garcia was immediately taken into custody Wednesday afternoon in the courtroom and taken to jail to begin his sentence.

PermalinkHe'll do ok. Most prison trash are "switch hitters", and are perfectly fine with spending intimate time with other men while incarcerated.
