SAN ANGELO, TX -- A probable cause affidavit revealed what is believed to have transpired in the final moments of a San Angelo man's life before being shot and killed on Tuesday.
Ernesto Moreno Hernandez, 28, was shot and killed around 4:30 p.m. on Tuesday. Police arrested 43-year-old Gabriel James Ortiz and charged him with murder, a first degree felony punishable by death.
The affidavit accuses Ortiz of entering the back yard of the house at 2013 Bailey St. and shooting Hernandez multiple times. A detective on the scene said "he observed two torso wounds and wounds to the head," according to the affidavit.
A witness heard a gunshot then entered the alley behind Bailey. After hearing another shot, the witness heard someone "say something to the effect of, don't do it" before a Hispanic man, later identified as Ortiz, fired two more shots "at a downward angle." The witness moved closed and found a victim lying on the ground at the angle in which he saw the gunshots fired.
Another witness told detectives he was down the street when a man "wearing a Harrison roofing shirt" told him to call 911 "because he had just shot someone."
First responders at the scene were advised to look out for a Hispanic man wearing a green shirt and yellow hat. Police located a subject in the west part of the front yard who matched the description and later identified himself as Ortiz, the affidavit said.
Authorities found a Glock handgun in the back yard before observing Hernandez's body covered by a sheet.
Ortiz is currently being held in the Tom Green County Jail on $250,000 bond.
