Man Found Guilty of Negligent Homicide; Allowed One More Day of Freedom

 

SAN ANGELO, TX – Fredrick John Gomez, 26, charged with criminal negligent homicide after causing the death of Fabian Ortiz, was present on Wednesday morning to plea true to his motion to revoke probation.

According to court documents, Gomez, then 17-years-old, caused the death of Ortiz after Ortiz succumbed to his injuries sustained from a motor vehicle accident.

Gomez’s indictment reads that the Grand Jury found Gomez accused of “operating a motor vehicle in a dangerous manner by moving the steering wheel back and forth while driving at a high rate of speed” at the time of Ortiz's death.

In June of 2011, Gomez pleaded guilty in front of the court and was placed on adult probation for a period of four years. He was originally indicted on a manslaughter charge. However, the state recommended a lesser charge of criminal negligent homicide in exchange for his plea of guilty.

On January 19, 2017, Gomez was arrested by San Angelo Police officers for Public intoxication and booked on a $442.00 bond. This violation of Gomez’s deferred adjudication led the court to move forward with revoking Gomez’s probation.

On Wednesday, Gomez sat before Judge Ben Woodward prepared to plead true to the motion to revoke probation.

Gomez court appointed an attorney, Joe Hernandez informed the court that Gomez has a doctor’s appointment on Thursday for his broken hand, and requested he be allowed to report in person to the jail.

Judge Woodward allowed the request but told Gomez to present himself to the jail as soon as the doctor’s appointment is concluded.

“You will report to the jail as soon as you leave the doctor’s office,” Woodward declared.

Moving forward with Gomez plea of true, Judge Woodward accepted the State's recommendation of 525 days in jail and sentenced Gomez for the charge.

“I now revoke [Gomez] probation and find you guilty of criminal negligent homicide,” Woodward stated.

Gomez must turn himself over to the jail by 5 p.m. Thursday or he will face a Third Degree Felony failure to appear charge.
