Attorney for Gomez Wrangles with Prior Aggravated Assault Conviction in Case of Fabian Gomez

 

SAN ANGELO, TX – Fabian Garcia Gomez, 29, of San Angelo was in District Court this morning for a plea hearing for aggravated assault with a deadly weapon. 

Gomez and his attorney Brian Raymond were prepared to enter a plea when 51st District Judge Barbara Walther informed Raymond that his client had previously been convicted of felony aggravated assault with a deadly weapon. 

Raymond appeared unaware of the previous conviction, but in an interview after the hearing clarified what happened. He said he was fully aware of the previous conviction. There were some issues to be taken care of in this case before the plea deal could be registered, he said.

According to court documents, Gomez was found guilty and sentenced to five years in state prison in May 2011, after an intoxicated Gomez threatened a Ricardo Verastegui with a knife at a San Angelo apartment.  Verastegui reportedly was Gomez’s sister’s boyfriend. 

In the latest incident, Gomez was indicted by a Grand Jury on one count of aggravated assault with a deadly weapon for stabbing Gilbert Mascorro in October of 2016

Judge Walther this morning said they would reset the plea hearing.
