SAN ANGELO, TEXAS – Multiple plea-deals took place Thursday morning at the Tom Green County Courthouse. Today's charges included an assault causing family violence charge ,and two charges for unlawful carry of a firearm by a felon.
Antonio Bennie Dozier, 25, on March 6, 2016, knowingly “[caused] bodily injury to the victim, a family member, by impeding the normal breathing or circulation of blood after applying pressure to the persons throat or neck,” Dozier’s complaint reads.
The victim confirmed to a San Angelo Police Department detective that she has been in a relationship with the defendant for three years. They have a two-year-old child together, and the victim was nine months pregnant at the time of the assault.
The day of the incident, she awoke to the defendant standing beside her bed as he accused her of cheating on him. “The defendant wrestled with [her] as she attempted to get out of the bed,” the complaint reads. “The defendant got on top and choked her using one hand behind her neck and the other in front of the neck, impeding the victim’s breath.”
Dozier proceeded to push her face down to the mattress as he covered her mouth, further impeding breath circulation.
Additionally, “[Dozier] used the victim’s panty to wrap it around her neck to chock her [further].”
On Thursday, Dozier appeared before the 340th Judicial District Court Judge Jay Weatherby, to plead incompetence before going forward with his trial.
Weatherby asked if both councils agreed with the motion, and after confirming agreement, ordered Dozier to be admitted into a state hospital for 120 days. The validation of his incompetence will be confirmed after the medical evaluation.
Also in court Thursday morning was Matthew Brown, 25. Brown is charged with Unlawful Possession of a Firearm by a Felon, a Third Degree Felony.
On Oct. 9, 2016, Brown was involved in a verbal argument, which escalated into a physical confrontation, his complaint reads.
Devin Lohse detailed in the complaint that Brown and another suspect, Tommy Lee McCutchen, 28, both brought out a long-barrel firearm and had them exhibited in a threatening manner.
According to Lohse, the defendant discharged a live round during the confrontation, striking the victim in the left side of her abdomen, causing serious bodily injury.
Brown confessed in a pre-arrest interview, that he and McCutchen both brought shotguns during the incident. Following the execution of a search warrant of the property and residence, both guns were located with empty shell rounds in them.
Brown plead guilty to the charge and was issued a punishment of five years in the institutional division of the Texas Department of Criminal Justice. In addition, the state would dismiss the un-adjudicated offense for aggravated assault with a deadly weapon under the ruling of Sec. 12.45 of the Texas Penal Code.
The last to appear before Judge Weatherby was Napoleon Ramirez Castaneda Jr., 30, who is also charged with Unlawful Possession of a Firearm by a Felon.
Castaneda accepted a plea-deal after being charged with carrying a firearm before the fifth anniversary of his community supervision.
Castaneda was charged with the offense on Oct. 23, 2016, after police responded to a shots fired call in the area of 58 E 9th St. After investigating the scene, police located cartridge casings in the front yard of a residence. Castaneda was very calm when speaking to police and confirmed he had been firing bullets-off at the residence, Castaneda's complaint reads.
Judge Weatherby accepted his plea of guilty and issued him a six year sentence in the Institutional Division of TDCJ, and a fine of $1,500. However, the state also gave a probated sentence with the plea-deal, which places Castaneda on a six year probation for the offense.
