DALLAS, TX — A Texas man is suing Baylor University Medical Center and three surgeons after discovering a nearly 10-inch surgical instrument had been left inside his body following cancer surgery.
An X-ray ordered by his doctor revealed the instrument, which Nava’s attorney, Les Weisbrod, displayed during a Wednesday news conference. Four days after the tumor removal, Nava underwent a second operation to remove the tool.

Dallas attorney Les Weisbrod, representing Nava, said he and the family attempted to settle with the hospital before filing suit, but the offer was refused.
Matthew Olivolo, a spokesperson for Baylor Scott & White Health, expressed “deep regret” for Nava’s experience in a statement and said the system has reinforced safety protocols and training.
Nava, now cancer-free, said he still struggles with depression, sleeplessness and fear about future medical procedures.
