Abilene Man Charged with Murder in Fentanyl Overdose

ABILENE, TX – The Abilene Police Department Narcotics Unit, assisted by the Taylor County District Attorney’s Office, has charged a 39-year-old Abilene man with First Degree Felony Murder.

According to APD, this happened on Jan. 22, 2024, when 21-year-old Michael Scott Henderson Jr. was discovered deceased in a small shed behind a residence on Locust St.

The death appeared to be due to an apparent overdose, information from the department stated. A lengthy investigation led to the subsequent arrest of Antonio Pena. On March 25th, 2025, members of the Abilene Police Department's Narcotics Unit served an arrest warrant on Pena at his residence.

Texas House Bill 6, passed during the 88th Texas Legislative Session and effective Sept. 1, 2023, broadened the definition of murder and allows prosecutors to seek murder charges against individuals who manufacture or deliver Fentanyl that results in a person’s death.

The Abilene Police Department reminds the public to remain aware of the dangers of Fentanyl and emphasizes its "relentless pursuit" of Fentanyl dealers.
