Sexagenarian Indicted for Exposing Himself to Boy in Public Gym

 

SAN ANGELO— A San Angelo man has been indicted for exposing himself to a minor in a sauna of a local gym.

David Edward Smiley, 68, of San Angelo, was indicted by a Tom Green County grand jury in March for Indecency with a Child by Exposure.

According to court documents, on November 12, 2023, a 14-year-old boy alleged that Smiley exposed himself at a gym sauna. Smiley allegedly approached the boy and sat directly next to him in the sauna. He removed his towel and exposed himself to the child then asked if the child would perform a sexual act on him.

The child told him no and left the sauna.

During a custodial interview with Smiley, he waived his rights and agreed to speak. Smiley said he was in the steam room with the child who was wearing shorts. Then, Smiley said he left the room, and the child followed him and exposed himself to Smiley and they went back into the sauna.

Smiley was allegedly sexually attracted to the child victim and sat next to him in the steam room and exposed himself. Smiley allegedly admitting to maybe touching himself in a sexual way in the room and asked the child to perform a sexual act on him.

Smiley said that the child told him no and left the room.

Smiley was arrested on November 12, 2023, and was released on November 13, 2023, on $25,000 bond. He currently has a jury trial set for July 15, 2024.
