San Angelo Man Arrested for Exposing Himself to Child at Gym

SAN ANGELO— A San Angelo man has been arrested for indecency with a child after exposing himself in a sauna.

David Smiley, 67, has been arrested for Indecency with a Child by Exposure after sitting down next to a minor in a sauna at a local gym, exposing himself, and asking for oral sex.

According to court documents, on November 12, 2023, Smiley exposed himself to a 14-year-old child for his own sexual gratification.

The 14-year-old male victim said in a sworn statement that at a local fitness center located in southwest San Angelo on November 12, 2023, he was working out and went into the sauna to recover. Smiley was allegedly naked under his towel in the sauna, got up, and went to sit next to the child.

According to the victim, Smiley then removed his towel and exposed himself. Then, Smiley began touching himself when the minor moved away from him. Smiley got up and followed the victim then asked for oral sex. The minor said no and left the sauna.

During a custodial interview with Smiley, he waived his rights and agreed to speak with the investigator. Smiley said that on November 12, 2023, while at the fitness center, he was in the steam room with the 14-year-old victim, who was wearing shorts. Then, Smiley says he left the steam room only for the child to follow and expose himself to Smiley then went back into the steam room. Smiley allegedly was sexually attracted to the child and went back into the steam room.

There, Smiley said he sat down next to the child and exposed himself and said he may have touched himself. Smiley then asked if the child wanted oral sex. The child told Smiley no and left the steam room.

Smiley was arrested on November 12, 2023, and booked into the Tom Green County Jail. He was released the next day on $25,000 bond.
