Ozona Coyote Indicted for Capital Murder

 

OZONA, TX — A Crockett County grand jury in Ozona handed down a 14-count Capital Murder indictment and a separate 22-count indictment for smuggling of persons with a likelihood of causing death and with a firearm against the Ozona Coyote, Rassian Nateray Comer of Bossier City, Louisiana, on June 13. We obtained copies of both indictments Friday afternoon.

For Capital Murder, the indictment details allegations that Comer caused the death of Maria Socorro Alvarez-Tambunga by driving a vehicle at an excessive rate of speed, failing to stop at a stop light, and causing his pickup to collide with Mrs. Tambunga’s pickup truck. Count 1 also accuses Comer of killing two of his passengers, Ignacio Coca Guzman and Rodrigo Soriano Santiago, who were illegal migrants Comer was smuggling, thus the deaths were caused during a criminal transaction, the indictment stated.

Count 2 for Capital Murder is for killing Mrs. Alvarez-Tambunga’s granddaughter, Emilia Brooke Tambunga, who at seven years old was under 10 years of age, a statuary age that is used to enhance the charges.

Counts 3 through 6 charge Comer with Felony Murder for the deaths of the death of the four souls. Counts 7-10 charge Comer with Manslaughter for the same deaths and counts 11-14 add on charges of Criminally Negligent Homicide. In the latter counts, the indictment stated that Comer was using a deadly weapon, his pickup truck, and doing so in the act of a charged offense while exhibiting a deadly weapon.

In the second, 22-count indictment, Comer was charged with Smuggling of Persons While Causing Serious Bodily Injury or Death, a First Degree Felony in Texas. Counts 1 and 2 involved the two deaths of illegal migrants, named above, who were Comer’s passengers. Counts 3 through 11 list the nine additional illegal migrants who were Comer’s passengers. The charge, Smuggling of Persons with Substantial Likelihood of Serious Bodily Injury or Death, is a Second Degree Felony, and lists the remaining victims allegedly stuffed in Comer’s pickup:

  • Moises Coca Guzman
  • Octavio Zuniga Viregas
  • Hector Maldonado
  • Noe Zuniga Viregas
  • Juan Esteban Torres
  • Abel Mejia
  • Lazaro Guzman
  • Wilfredo Hernandez-Flores
  • Jhovanni Trejo-Olvera

In counts 12 through 22, Comer is charged with Smuggling of Persons While Possessing a Firearm, a Second Degree Felony. Each of the 11 illegal migrants who were passengers inside Comer’s pickup truck account for each count.

On the evening of March 13, Comer crashed his pickup into Mrs. Alvarez-Tambunga’s pickup at the service road intersection of Interstate 10 and SH 163 while being chased by Crockett County Sheriff’s Deputies. Speeds in the high speed pursuit reached speeds of at least 105 mph, as recorded on Facebook Live by Comer during the chase. Alvarez-Tambunga and her granddaughter Emilia were killed in the crash along with two of the 11 illegal migrants who were passengers in Comer’s pickup.

Comer is currently held in the Crockett County Jail in Ozona. Capital murder is punishable by death or life in prison. Each First Degree Felony carries a penalty of 5 to 99 years in prison. Second Degree Felonies carry with them a punishment of two to 20 years in prison.
