SAN ANGELO, TX – A San Angelo man who pleaded guilty to murder last month is now asking the 119th District Court for a new trial and one of the reasons is because of coverage by San Angelo LIVE!
As previously reported, in May 2019, four suspects were charged with the murder of 26-year-old Kristin Rose. For the original story see: Gory Details Emerge About the Murder of Kristian Rose
The four charged were Alexis Jackson, Brian Garcia, Jacob Martinez, and Joshua Jaquez. Each of them took plea deals. Jackson got 35 years, Martinez got 35 years, Garcia got 50 years, and Jaquez got the least amount of time with 25 years.
Despite that Jaquez and his defense attorney Emily Detoto have submitted a motion for a new trial. The motion claims that there were multiple reasons why the plea deal was not fair. They claim that the court has a bias against the Jaquez family.
The main reason for the request was after another murder trial. In Mar. 2023, the 119th District Court held the park 2400 murder trial. During the trial, prosecutors alleged that Joe Angel Trevino killed Jason Garivay in the parking lot of the Park 2400 in Jun. 2021. During the trial, a Tom Green County jury acquitted Trevino after he claimed he acting out of self defense.
Jaquez and his attorney claim that the other case showed a bias because Garivay is Jaquez's Uncle. On the final day of the Park 2400 murder trial, 10 deputies, DPS troopers, and even Sheriff Nick Hanna were in the courtroom to ensure safety after the verdict was read. They claim this along with the San Angelo LIVE! article titled 'Joe Angel Acquitted of Park 2400 Murder' allegedly played a role in Jaquez getting a long term sentence.
Jaquez signed a plea deal just 12 days after his uncle's trial. On that day, he accepted the term of 25 years in prison. He was sent released to the Texas Department of Criminal Justice on Apr. 28, 2023 at 8:28 a.m.
He will now await the judge's decision.
