Lubbock Man Indicted for Murder in Christmas Gunfight

 

LUBBOCK, TX –– A Lubbock County grand jury has indicted a 44-year-old man in connection to a murder that took place during the Christmas holiday.

According to court documents, on December 26th Lubbock County Sheriff's Office deputies were dispatched to the area near 79th Street and Ave F for reports of shots fired.

Responding officers located the victim, 68-year-old Alberto Garza Sr. with a serious gunshot wound. Garza ultimately succumbed to his injuries at the scene.

Deputies also located 42-year-old Timothy Lovato, with a gunshot wound. He was transported to UMC for treatment of a serious injury.

Lovato told investigators he saw his neighbor, Garza, arguing with a Hispanic man. Then the shooting of both victims occurred.

The suspect, identified as Joshua Walker, fled from the scene in a white delivery box truck.

During an interview with investigators, Walker stated he spent all of December 26th at his home "drinking heavily." He stated it "was possible that he left the residence but was so intoxicated that he could not remember what he did.”

Walker admitted to owning firearms that matched the caliber of the bullets found at the scene and the white delivery truck described by Lovato.

Garza was indicted by a grand jury on one count of first-degree felony murder. 

He is currently being held at the Lubbock County Detention center on a $500,000 bond.
