SAN ANGELO, TX- A San Angelo man has been indicted by a Tom Green County grand jury on 4 counts of aggravated assault with a deadly weapon.
Eliseo Rivera has been indicted for his role in the shooting that occurred at the Texas State Bank Sports Complex, located at 1615 Rio Concho Drive.
According to court documents, on May 22, 2021, police arrived at the Texas State Bank Sports Complex for a shooting call.
Investigators and talked to witnesses who alleged altercation started between two females. As the altercation progressed, multiple males started towards the fight and became involved to try and stop the altercation.
Rivera allegedly approached the group and displayed a firearm to them. Rivera removed the gun from his waistband and discharged the firearm two to three times into the ground. The discharged rounds caused both concrete and bullet fragments to strike several people, including a child.
After the shots were fired, Rivera allegedly fled the area to change and dispose of the gun according to witnesses. Rivera returned to the location without the firearm and got into another altercation with the original subjects from the initial confrontation.
Shortly after the second altercation started, an officer with the San Angelo Police Department arrived and took Eliseo Rivera in without incident.
An adult softball tournament was being played that night and 4 victims were hit by shrapnel from the gunshots.
Victim 1, who was at the softball tournament heard and saw a large fight start. This victim went over to break the fight apart when several gunshots went off. This victim was struck in the neck area by shrapnel trying to protect some of the children from being hurt.
Victim 2 was a participant in the softball game adjacent to where the large fight started when the gunshots went off. Victim 2 was struck in the shoulder by shrapnel shielding a child.
Victim 3 was also participating in the softball games and was struck in the forehead by shrapnel then fell to the ground.
Victim 4 was not spoken to by investigators due to the victim’s age.
Rivera was Mirandized and said he did have a gun on him, and he did fire multiple rounds into the ground only to prevent him and his friends from being “jumped” by the individuals in the altercation.
Eliseo Rivera was arrested and booked into the TGCDF on May 23, 2021 and released later the same day on $30,000.00 bond.
