Three San Angelo Police Officers Sued Following Viral Video

 

SAN ANGELO, TX – The three San Angelo Police officers who allegedly assaulted a man at Walmart are now being sued according to federal court documents.

As previously reported, on Jan 6, the San Angelo Police Department released body cam footage of an incident at Walmart where three officers allegedly assaulted an individually wrongfully accused of harassing people. See:WATCH: SAPD Releases Body Cam Footage of a Viral Video

Now the man who was assaulted, Jack Miller, has filed a lawsuit against the three officers for the damages that occurred during the incident.  Miller's suit alleges his fourth amendment rights were violated. 

According to the suit filed in federal court, the officers deprived Miller of his constitutionally protected right to be free from unreasonable seizures under the Fourth Amendment by unlawfully arresting him despite lacking probable cause that any crime had been committed as he was not under arrest at the time he was asked and then refused to identify himself.

The suit alleges that San Angelo Police Officers Francis, Webber, and Mayberry caused emotional distress, torment, and mental anguish in the past and future, caused physical injuries, physical pain and suffering as well as depriving Miller of his liberty.

This suit was filed in federal court since Miller alleges that his constitutional rights have been violated. He has hired Scott Palmer, an attorney from the Dallas Metroplex area. 

Because this is a constitutional case rather than a civil case sovereign immunity does not apply to the officers.

Tell the cop your damned name! If it is not you they are looking for, that will speed them on their way to find the right guy. Why not be co-operative? People are so damned hung up on their rights they make issues out of nonsense, are belligerent, then wonder why the situation escalates!!
