Teenager Indicted in San Angelo for Recording Lewd Act

 

SAN ANGELO, TX – A Tom Green County grand jury indicted 19-year-old James Kyle Floyd on July 8 for sexual assault after the victim contacted authorities stating she saw a light that appeared to be a cellphone flashlight while she was being sexually assaulted by Floyd, according to court documents.

On the afternoon of March 12 officers with the San Angelo Police Department were dispatched to a residence off S. A&M Ave. following the report of an alleged sexual assault.

When authorities arrived on scene they began to question both parties involved as well as several other individuals who were on scene at the time of the reported incident before allowing everyone to leave. 

Several hours later the victim contacted SAPD once more stating she recalled possibly seeing a "light" from Floyd's cellphone and hearing a video playback of him moaning indicating Floyd might have recorded the alleged assault.  

On March 17 investigators met with Floyd and seized his phone following a secondary interview.

The following day a search warrant was executed on the seized cellphone where investigators made several findings including multiple recordings and cell phone activity corroborating the allegations made by the victim.

During a follow up interview Floyd admitted to authorities that he previously used his phone to record a sexual encounter with another female in the past.

As the investigation continued authorities discovered there were several missing media files from the time of the assault and "consistent access and use" of the files by Floyd.

On March 20 an arrest warrant was issued by the Justice of the Peace for the arrest of James Floyd.

On March 26 Floyd was arrested and booked into the Tom Green County Jail on the suspicion of invasive recording, but was released the following day after posting roughly $7,500 in bond. 

An indictment was filed on July 8 charging Floyd with Sexual Assault which is a second degree felony punishable by up to 20 years in jail, and fines not to exceed $10,000.
