SAN ANGELO, TX – A Tom Green County grand jury indicted a man in December after the Texas Department of Public Safety recieved a tip from the Center for Missing and Exploited Children.
As previousily reported, on October 23, the Texas Department of Public Safety arrested Dustin McVinnie for two counts of sexual assault of a child and possession of child pornography.
The arrest came after a nearly two-month long investigation beginning on September 3 when the National Center for Missing and Exploited Children sent a Cybertip to DPS. The tip said that on May 22 McVinnie downloaded two videos containing child pornography.
A few days later, on September 6, the Trooper determined that McVInnie did download the file and submitted for a search warrant. On September 12, Special Agents with the DPS's Criminal Investigations Division executed the warrant and seized "one electronic device."
McVinnie was then interviewed where he told the Troopers how he knew the child. He said it started by him sending a friend request to the child but didn't check the age located on the profile. He admitted that once the request was accepted the two conversed in a sexual natured conversation. Eventually the two exchanged in videos of them masturbating.
"I didn't really want to get in trouble" said McVinnie after telling Troopers that, once he knew she was a child that he deleted her off the app. McVinnie also admitted to having sexual relations with multiple girls under the age of 17 in 2018.
Nearly a month later, the child victim was located and interviewed. She told Police that on November 20, 2018. McVinnie invited her to his apartment where the two engaged in oral and regular sex. After dropping her off the following morning, McVinnie deleted and blocked the child. McVinnie then added her back on May 18 and on May 22 McVinnie received the videos that started the tip and investigation.
The same day, Troopers became aware that McVinnie was also a suspect in a sexual assault from 2012. They met with the second child victim who described what happened that day.
The child said that in October of 2012, McVinnie showed up to the child house and was let in. After letting him in, the child went to the kitchen to get a drink and McVinnie followed. The affidavit states that this is when McVinnie went behind the child, pulled the child's pants down, and forcefully penetrated the child's anus.
During the assault that child told McVinnie to stop numerous time and he only did once the child began crying.
McVinnie was arrested and placed into the Tom Green County Jail on October 23. He remains in there in lieu of a $920,000 bond.
He has a post indictment reporting hearing scheduled on January 8 at 2:00 p.m.
