Biker Sentenced for Crashing Into and Killing His Son and Two Others

 

ODESSA, TX-- A man was sentenced 35 years in prison after pleading guilty to killing his son, his uncle and one other person. 

According to CBS 7 Jose Benavides, his son Erick, and his uncle Augustine Gomez, spent the day riding their motorcycles around the Odessa area.

At around 8:30 Erick and Augustine got ahead of Jose when Erick crashed into another vehicle on highway 80.

After the wreck two bystanders stopped to help Erick get his bike onto the center shoulder. After hearing about the accident Jose came soaring to the scene, but lost control of the motorcycle.

He them rammed into his son and uncle killing them instantly.

The by-standers who were there helping Erick were also hit. Joshua Brown died on the way to the hospital, and Janice Young was also hurt.

Investigators have reported that that Benavides had a blood alcohol level of .20, or 2.5 times the legal limit.

Benavides pleaded guilty to three counts of intoxicated manslaughter and one count on Intoxicated Assault. The judge sentenced him to 38 years in prison.
