Brady Man Fights with Police and Damages Squad Car While Resisting Arrest

BRADY, TX -- Brady Police arrested a Brady man after he refused to leave the scene of an unattended child investigation.  According to a news release from the Brady Police Department, At approximately 8:05 a.m. Sunday morning a Brady officer was dispatched to the 1700 Block of Old Mason Road in reference to an unattended child in the area.  

During the initial investigation, police questioned 34-year-old Damion Maxwell as an initial witness.  Maxwell began cursing and acting strangely according to police.  

Maxwell was asked to calm down numerous times before being asked to leave the area or risk arrest for Disorderly Conduct.  He initially complied, but then went to a nearby street corner and continued yelling obscenities at police and witnesses from a distance.  

Once the unattended child issue was resolved, the officer approached Maxwell and again warned him about his conduct and language, allowing him another opportunity to  go home.  

At this point the officer called for additional assistance, provided a physical description of Maxwell and told him that he was no longer free to leave and was under arrest.  As the officer walked towards him to take him into custody, Maxwell removed a medium-size pocket knife from his jacket, extended the blade and kept it in his right hand while taking a defensive posture.

The Police officer and a sheriff’s deputy  attempted to calm Maxwell down and issued verbal commands for him to drop the weapon and comply with their directives, but Maxwell ignored them.   He was making strange and irrational statements calling the officers on scene “fake cops” while continuing to refuse to simply drop the knife.

Maxwell attempted to walk from the scene towards another residence and appeared to put the knife back in his pocket.  As he stepped onto the porch area of the home, the officer attempted to grab him and take Maxwell to the ground.  

Maxwell was able to break free and began running until he was caught and tackled by the Brady officer.  Three State Troopers heard the call for additional assistance and responded to assist the officer in restraining Maxwell for transport to the jail.

While being transported to jail, Maxwell kicked out the rear passenger window and repeatedly kicked at the door of the squad car until it separated from the frame.  

Several officers were then needed to further restrain Maxwell before he could do more damage to himself or the vehicle.  Once at the jail, Maxwell remained uncooperative and had to be carried into a cell.

Maxwell is facing numerous felony charges for this incident, including assault on a peace officer, resisting arrest with a deadly weapon, attempting to take a weapon from a peace officer, criminal mischief and disorderly conduct.
