SAN ANGELO, TX -- Erick Ramos, 19, one of three charged with the capital murder of Juan Gurrerro and Zane Lopez, appeared in court Thursday afternoon for his second pre-trial this month.
The hearing started with a decision regarding defense attorney Frank Brown’s previous motion requesting evidence from the last five years of interviews conducted by San Angelo Police Department (SAPD).
At the last pre-trial, Brown presented two videos to 340th Judicial District Judge Jay Weatherby, who is presiding over Ramos’ trial.
The videos showed a statement taken by San Angelo Police officers, which Brown plans to use to suppress Ramos’ confession. He said he would use the requested interviews to show a pattern of abuse with Miranda rights by the SAPD.
District Attorney Allison Palmer thought the motion was excessive and wouldn’t yield the desired result for the defense council.
Judge Weatherby denied Brown's motion for the sake of saving time going forward with the trial. In addition, Brown said he would prepare a motion of suppression regarding evidence that was found in the vehicle connected to the shooting. The motion will be finalized by the next pre-trial scheduled for Aug. 7th.
Judge Weatherby asked both councils if there were other motions needing to be discussed going forward. The State made a request for court room A to be used for jury selection. Given that the jury trial is set for Sept. 18, Weatherby was hesitant to confirm the request due to the courthouse having a busy schedule around that time.
He did say the court would look into the possibility of using court room A for jury selection. With no other motions presented, the court was adjourned and Ramos returned into the custody of Tom Green County Sheriffs detention officers for transportation to the jail.
