Argueta was indicted for making the improper visual recording on April 6, a state jail felony. He pled guilty to the charge on Oct. 14 and was sentenced to 270 days in a state jail facility; however, he still has a border patrol hold due to his status as an illegal immigrant. State jail felonies are punishable by 180 days to two years' confinement.
The victim in the incident was a 45-year-old Hispanic woman, who relayed to police that she saw the cell phone on the floor and realized she was being recorded. Argueta allowed police to view the contents of the phone, and they located the video of the woman.
Argueta has remained in the county jail since the incident took place.
