Man Who Attempted to Kidnap an Autistic Child is Going Back to Prison

 

SAN ANGELO, TX – The man accused of trying to kidnap a small autistic child in the Allsup's parking lot has pleaded guilty in Tom Green County and is now facing federal charges.

As previously reported, on July 2, 2019, officers with the San Angelo Police Department were dispatched to the Allsup's on North Main and the Loop 306 for the report of an attempted kidnapping. When they arrived they spoke with the mother of two small boys who told the officers that her sons were nearly kidnapped. She claimed that while she was attempting to pump gas a man got into the back seat of her car. 

“I had just finished putting my credit card in the pump,” the mother said to San Angelo LIVE!. “When I turned around to check on my kids in the back seat, I saw a third head!”

The man inside the vehicle was later identified as Anthony Aguero, 49, attempted to grab one of the children from the back seat. The child was able to escape before anything happened. “I saw my son grabbing for dear life on his little brother’s car seat.” said the mother. She said she was especially concerned since the boy is autistic. 

Aguero told police on scene that he had been there all morning waiting on a ride and just got into the wrong car. Clerks at the store also told officers Aguero told them he was waiting on a ride but had been hanging around the parking lot all morning. 

Aguero was then arrested and charged with unlawful restraint. That charge was later increased to attempted kidnapping. After a year of jumping around jails Aguero took a plea deal offered to him by the District Attorney's Office.

In the deal Aguero pleaded guilty to the charge and in return would only spend 1 year in TDCJ state jail and then pay $118 restitution. Since he had already spent a year in the Tom Green, Taylor, and Bailey County Jails he had already served his time for the charge. Aguero was placed on a US Marshal hold for a federal charge.

Previousily in 2013 Aguero faced federal charges for a number of counts of Possession of Forged and Counterfeited Securities and mail theft. He was sentenced three years in prison and then three years supervised release. That supervised released began November 2, 2018. According to the motion on November 16, 2018, Aguero admitted to his probation officer that he had used prescription opiates that were not prescribed to him and alcohol on November 3, 2018. This, an unsupervised trip to Junction, and attempted kidnapping violated the rules of his probation. 

Aguero was released from the Tom Green County Jail on July 29 at 12:13 p.m. to US Marshals for the charges and will now be heading back to federal prison.
