Andrade Sentenced to Five Years in Molestation Case

SAN ANGELO, TX -- In what District Judge Jay Weatherby called a difficult case, 19-year-old Moises Andrade was sentenced to the minimum five years in prison for three counts of aggravated sexual assault of a child.

Defense attorney Joe Hernandez presented evidence that Andrade has been in and out of mental health treatment for years and was on medication for mental and developmental issues.  Andrade was a patient of MHMR of the Concho Valley as well.

Andrade asked for advice from his church because he was feeling remorse for the four victims of his crimes.  According to testimony, Andrade was advised to go to the police and confess which he did.

Judge Weatherby said if Andrade had not confessed to police, he probably never would have been prosecuted for the sexual assaults.

Relatives of Andrade and of the victims submitted letters to the court requesting deferred adjudication saying they believed Andrade was not threat to the victims or society.  Judge Weatherby said, “Folks, these are not easy cases.  There are always variations in the facts and this is one of those cases.”

Judge Weatherby said that based upon the evidence he couldn’t find that Andrade was no longer a threat to society.

Andrade was facing five to 99 years or life in prison.  He was sentenced to five years on each of the three counts of sexual assault of a child.  He was remanded into the custody of the Tom Green County Sheriff’s Office and taken to jail.
