Prosecutors Seek Finding of a Deadly Weapon in Weidner Hit-and-run

 

SAN ANGELO, TX -- Prosecutors filed a motion Friday seeking a finding of use of a deadly weapon in the hit-and-run case against Brandi Weidner in preparation for her December jury trial.

Weidner is set to stand trial for the hit-and-run death of Gunnar McNeill three years ago.  Weidner was indicted for an Accident Involving Death, a Second Degree Felony, in January of 2016.  If the court finds that Weidner’s vehicle was used as a deadly weapon, that finding would enhance the punishment in the felony.  

Weidner was booked into the Tom Green County Jail after the Tom Green County Sheriff’s Office served her with a warrant stemming from an incident that occurred on the night of Dec. 22, 2014 and early morning of Dec. 23.

On that day, Weidner was involved in a crash that killed pedestrian Gunnar McNeill. According to court documents, she “intentionally and knowingly” failed to stop the vehicle at the scene of the crash, or as close to it as possible.

While she was out on bond, Weidner was arrested in Grape Creek for Driving While Intoxicated.  Following that arrest, District Judge Jay Weatherby increased her bod to $150,000.  She remains in jail.  

Gunnar McNeill’s mother Kerry Sharp isn’t sure the trial will take place in ten days.  “I’m afraid it’ still going to be postponed.”  Sharp said in an interview on the steps of the Tom Green County Courthouse.  “It has been three years already.”  

Sharp and other members of McNeill’s family have attended every hearing in the Weidner case.  

Weidner’s jury trial is set for Monday, December 11 at 9 a.m. in the Tom Green County Courthouse.
