Judge Weatherby Delays Manslaughter Trial for Keene

 

SAN ANGELO, TX – District Judge Jay Weatherby granted a motion for a continuance by defense attorneys Friday for Michael Gary Keene delaying his jury trial until November. 

The 22-year-old Keene was originally charged with accident involving death in the June 2015 hit and run death of 23-year-old Gisele Jarmon.  On June 1, 2017 he was indicted on a charge of manslaughter. 

Jarmon was a special needs adult living with her parents.  In court, attorneys said she left her house for some reason and was struck by a vehicle on the Loop 306 access road at Southwest Boulevard near the Olive Garden restaurant. 

Keene was in court for a pre-trial hearing on a motion for a continuance.  Defense attorneys J.W. Johnson and John Carroll requested more time to prepare for trial because new evidence from the San Angelo Police Department was given to prosecutors and then passed on to the defense earlier this week. 

Judge Weatherby said, “I don’t like putting this case off.  I don’t want to put it off; however, in order to have a careful and correct trial, I am granting a continuance.”

The trial had been delayed previously. 

The judge and attorneys agreed to set the jury trial date for November 13, 2017 at 9 a.m. 

Carroll also informed the Judge Weatherby that he represents Paige Weatherby in a shooting death case.  In 2009 Judge Weatherby’s cousin died of a gunshot wound.  Carroll told the Judge that his client, Paige Weatherby was indicted for that shooting. 

Judge Weatherby and defense attorneys agreed that would have no bearing on Keene’s case. 

Keene has another pre-trial hearing on a motion for a change of venue.  Defense attorneys contend that Keene cannot get a fair trial in San Angelo because of pre-trial publicity and social media posts from both Keene and family and friends of Jarmon. 

Judge Weatherby ordered both prosecutors and defense to stay off social media.
