Abilene Couple Accused of Killing Their Newborn Baby Charged With Capital Murder
ABILENE, TX -- An Abilene man was re-arrested on Wednesday after his charge was enhanced to capital murder in the death of his new born baby .
According to the indictment, Damian Cate, 24, "knowingly caused the death" of Ashely Nevaeh Cate after he used a knife to cut her throat. He was indicted last Thursday.
Cate and his girlfriend, twenty-year-old Amber Craker, were both charged with murder and tampering with evidence in January of 2016. They were both arrested and charged after the daughter's body was found in a trash can in a South Abilene home.
Cate was released on May 26 after bonding out on a $100,000 bond. He was re-arrested on Wednesday with the enhanced charge. Craker, who was still in jail, was charged with capital murder on Friday.
According to Taylor County District Attorney Jim Hicks, a grand jury found probable cause in charging Craker with the capital murder of her child.
Craker's original murder trial was scheduled for June 12, however, a new trial date hasn't been set for the enhanced charge. Cate's trial is scheduled for July 17.
Cate's new bond is $150,000, while Craker's is $550,000.
